1. Scope of application
These general terms and conditions of sale apply to all product sales made by Pack’N Food Solutions, whose registered office is located in Jalhay, Route de Verviers 70, registered under number 1025.746.789. By placing an order, the customer accepts these terms and conditions without reservation.
2. Products
Pack’N Food Solutions offers food-grade cardboard packaging compliant with current standards. The characteristics of the products are described on the website www.packnfoodsolutions.be and in the catalogues.
3. Orders
Orders may be placed by telephone, by email or via the website. Any order is considered firm and final after confirmation by Pack’N Food Solutions.
4. Prices
Product prices are indicated in euros, including all taxes (VAT included). Pack’N Food Solutions reserves the right to modify its prices at any time, but products will be invoiced based on the rates in force at the time of the order.
5. Payment
Payment may be made by bank transfer, credit card or any other agreed method. Payments must be made within 30 days following the invoice date.
6. Delivery
Deliveries are made to the address indicated by the customer when placing the order. Delivery times are indicative and may vary depending on availability. Pack’N Food Solutions cannot be held liable for delivery delays caused by external events.
In the event of delivery on Euro pallets, these will be exchanged at the time of delivery. Otherwise, they will be invoiced per pallet at the market price. Unless otherwise agreed, goods stored for more than three months or when the storage space exceeds 6 metres will be invoiced in full, increased by a logistics cost of €10 excluding VAT per pallet for each month started from the fulfilment of the aforementioned condition.
7. Complaints and returns
The customer must check the conformity of the products upon receipt. In the event of damaged or non-compliant products, the customer must inform Pack’N Food Solutions within 5 days of receipt. Returns will only be accepted if the products are in their original packaging and in perfect condition.
Any agreement with, and any order, offer and/or acceptance by the customer irrevocably binds the parties. Cancellation after delivery is no longer possible.
In the event of termination of the contract by or at the expense of the customer, for any reason whatsoever, Pack’N Food Solutions shall be entitled to compensation, including in particular loss of profit and costs already incurred, fixed as a lump sum at 15% of the price, any additional amount having to be proven by us. This compensation is the consideration allowing full and final release from the commitment through the payment of compensation deemed perfectly reasonable.
8. Liability
Pack’N Food Solutions cannot be held liable for any direct or indirect damage resulting from the use of the products. Pack’N Food Solutions’ liability is limited to the amount of the order.
9. Personal data
The information collected when placing an order is necessary for order management and the commercial relationship. It may be used for communication purposes, unless the customer objects.
10. Applicable law
These general terms and conditions of sale are governed by Belgian law. In the event of a dispute, the courts of Liège shall have jurisdiction.
11. Amendments to the General Terms and Conditions of Sale
Pack’N Food Solutions reserves the right to modify these general terms and conditions of sale at any time. Customers will be informed of these changes by email or via the website.
